BATON ROUGE, LA (FOX44) — It's still unclear at this time if federal prosecutors will seek the death penalty in the case of escapees Darian Pierce and Ricky Wedgeworth.

The pair broke out of a state police compound in Baton Rouge in March of last year.

Police say they then went on to kill Ohio businessman David Cupps in Mississippi.

The two are scheduled for trial on November 6, 2012.
